Security and Fraud Prevention

1. Our Security

We are responsible for protecting the security of the Data in our possession. We take commercially reasonable administrative, technical and physical steps to protect User Data and Personal Data stored on our servers against unauthorized access, accidental loss, alteration or destruction, and we comply with applicable laws and regulations and payment method regulations when handling User Data and Personal Data. However, no security system is completely impenetrable, and therefore we cannot guarantee that unauthorized persons will not be able to break through our security measures or misuse the Data in our possession. You provide User Data and Personal Data to us with the understanding that the security measures we implement may not be appropriate or sufficient for your business, and you agree to implement Security Controls (defined below) and additional controls that meet your individual requirements. We may, in our sole discretion, take any measures, including suspending your account, to maintain the integrity and security of the Service or Data or to prevent damage to you, us, purchasers/donors, or others. You waive any right to claim against us for losses incurred by you as a result of such measures.

2. Security of customers (purchasers of this site and the services and products provided by our company)

You are solely responsible for the security of the Data on your website or server or in your possession, as well as any other User Data and Personal Data that you are permitted to access and handle. You will comply with applicable laws and regulations and payment method rules in handling or holding the Data, and will provide us with evidence of your compliance upon request. If you fail to provide evidence of such compliance to our satisfaction, we may suspend your account or terminate these Terms.

3. Security Management

You are responsible for assessing the security requirements of your business and for selecting and implementing appropriate security procedures and controls ("Security Controls") to reduce the risk of exposure to a Security Incident. We may provide you with security controls or suggest certain security controls as part of the Services. However, your responsibility to protect your business is not diminished by any security controls we provide or suggest, and if you believe the security controls we provide are insufficient, you will need to separately implement additional controls to meet your requirements.

4. Fraud risk

Even if we may provide or suggest security controls, we cannot guarantee that you or any purchaser/donor will never be a victim of fraud. The security controls we provide or suggest may include processes or applications developed by us, our affiliates, or other companies. You agree to review all security controls we suggest and select those that are appropriate for your business to prevent fraudulent transactions, and to implement your own security measures other than those we provide, if appropriate for your business. If you disable or fail to properly use security controls, you may be subject to an increased likelihood of unauthorized transactions, disputes, fraud, losses, and similar events. Please note that you are solely responsible for losses you incur due to the use of lost or stolen payment credentials or accounts by fraudsters to conduct fraudulent Transactions with you, and that your failure to implement security controls will only increase the risk of fraud. We may help you recover lost funds, but you are solely responsible for losses incurred as a result of lost or stolen payment credentials or accounts, or disclosure of your username or password, changes to your deposit account, and other unauthorized use or modification of your accounts. We are not liable to you, and you waive any right to claim against us, for any losses incurred as a result of use of lost or stolen payment credentials or unauthorized use or modification of your accounts, unless such losses are caused by our willful misconduct. Furthermore, you will fully pay for all losses incurred by us as a result of use of lost or stolen payment credentials or accounts.
We may also provide Data to you if a Transaction may be fraudulent. We may incorporate your subsequent actions or inactions into our fraud detection models for the purpose of identifying potential future fraud. You understand that we provide such Data for your review, but that you are ultimately responsible for any actions you take or do not take in connection with such Data.
